01Introduction
These Terms of Service (“Terms”) govern your use of Bamajan's website, services, and products (“Services”). By purchasing or using our Services, you agree to be bound by these Terms. If you do not agree, you must stop using our Services.
- Customer
- The individual or entity placing the order, paying for the service, and holding the contractual relationship with Bamajan.
- Final Consumer
- The individual receiving the service, when different from the Customer. The Final Consumer has no direct contractual relationship with Bamajan.
- Operator
- An independent local entity engaged by Bamajan to physically execute the service in the destination country.

We operate as a service platform offering operational, logistical, and concierge-style services delivered either to the Customer or to a Final Consumer designated by the Customer.
03What Bamajan Is and Is Not
Bamajan is a service platform that contracts with you, the Customer, to deliver specific concierge and family-support services to a Final Consumer of your choosing, who is typically a family member residing in a destination country, including Iran.
Bamajan operates as follows:
- You purchase a service from Bamajan. Bamajan is your sole counterparty.
- Bamajan engages an independent local Operator in the destination country to physically execute the service. The Operator is a separate legal entity, operating independently from Bamajan, and is bound to Bamajan only through commercial service-purchase agreements.
- Bamajan supervises the execution and reports the result to you. The Operator does not have a direct commercial relationship with you.
- Transfer money on your behalf to any party
- Operate as a money services business, remittance service, or currency exchange
- Act as a marketplace between you and the Operator
- Provide services directly to the Final Consumer
- Engage in any transaction prohibited by the sanctions laws of the Netherlands, the European Union, the United Nations, the United States, or Canada
04Eligibility
To use our Services, you must:
- Be at least 18 years old
- Have the legal capacity to enter into a contract
- Provide accurate and complete information
- Purchase Services only for lawful purposes
If you act on behalf of an organization, you represent that you have the authority to bind that organization.
05Scope of Services
Bamajan provides various remote and coordinated physical services, including but not limited to:
- Concierge services
- Family support services and wellness coordination
- Coordination of medical appointments and administrative errands
- Gift or product delivery within agreed scope and value limits
- Other customized services within agreed legal boundaries
Additional Information Required
Certain services may require additional information such as:
- Full name of the Final Consumer
- Delivery address
- Specific instructions or authorization
We reserve the right to refuse services that violate laws, ethical standards, or operational feasibility.
06Ordering & Contract Formation
A contract is formed when:
- You submit an order through our website or communication channels, and
- We accept your order and confirm it via email, invoice, or internal approval.
All purchases are governed by these Terms and the corresponding invoice. We reserve the right to decline or cancel orders at our sole discretion, without obligation to disclose the reason.
07Payments & Billing
- All payments are processed via Stripe using secure industry standards.
- We do not store or access credit-card information.
- Prices are stated in the currency shown at checkout.
- All payments must be completed before the service is delivered unless otherwise stated.
- Invoices serve as a legally binding agreement.
Failed or Disputed Payments
We may suspend or cancel services if a payment fails, is reversed, or is suspected of fraud.
Taxes
All applicable taxes, VAT, or duties will be added to the invoice where required by law.
08Customer Declaration
By placing an order with Bamajan, you affirm and represent that all of the following are true:
- The Final Consumer is a family member, close personal relation, or individual personally known to you.
- To the best of your knowledge, neither you nor the Final Consumer is listed on any sanctions list maintained by the Netherlands, the European Union, the United Nations, the United States, or Canada.
- The order is for personal or family use, and not for resale, redistribution, or onward delivery to any unknown third party.
- You have the right to share the Final Consumer's personal information with Bamajan for the purpose of service execution, and you accept responsibility for informing the Final Consumer accordingly.
- The service you have purchased does not involve, and is not a substitute for, the transfer of money, value, assets, securities, or controlled goods to the Final Consumer or any other party.
- The information you have provided about yourself and the Final Consumer is accurate and complete.
A material misrepresentation in this declaration may result in immediate suspension of services, refund denial, account termination, and report to relevant authorities where required by law.
09Customer Responsibilities
The Customer agrees to:
- Provide accurate and complete information at all stages of the order
- Ensure the legality of the requested service in their own jurisdiction and the destination jurisdiction
- Inform the Final Consumer about relevant privacy obligations and the existence of this service
- Avoid placing orders involving illegal, harmful, fraudulent, or sanctions-evading activities
- Cooperate with our team to ensure proper service delivery
If incorrect or incomplete information is provided, Bamajan is not responsible for delays, additional costs, or failed delivery.
10Delivery to Final Consumers
When a service is ordered for someone else:
- The Customer guarantees they have the right to share the Final Consumer's personal data
- Bamajan or the Operator may contact the Final Consumer directly if required for service execution
- We are not responsible if the Final Consumer refuses the service or is unreachable
We reserve the right to request additional verification for security or compliance reasons, and to refuse delivery without further explanation.
11Refunds, Cancellations & Modifications
11.1 Refunds
Refunds may be issued only when:
- The service has not started
- The service cannot be delivered due to reasons attributable to Bamajan
- A legal requirement mandates a refund
We do not provide refunds when:
- Incorrect information was provided by the Customer
- The Final Consumer refused the service
- Local authorities imposed restrictions outside our control
- The Customer changes their mind after the service has started
11.2 Cancellations
Cancellation requests must be submitted before the service begins. Once a service is in progress, cancellation may not be possible.
11.3 Modifications
Modification requests may be accepted if operationally feasible and may incur additional charges.
12Prohibited Uses
You may not use Bamajan's Services for any of the following:
- Activities that are illegal under the laws of the Netherlands, the European Union, the country of the Customer, or the country of the Final Consumer
- Money transfer, remittance, value transfer, gift transfer of cash or near-cash equivalents, currency exchange, or any activity that has the economic substance of money transmission
- Transactions involving any person or entity listed on a sanctions list maintained by the Netherlands, the European Union, the United Nations, the United States, or Canada
- Delivery of medications requiring prescription, controlled goods, dual-use goods, or any item subject to export-control regulation
- Real estate transactions, securities transactions, or business transactions on behalf of the Final Consumer
- Services to a Final Consumer the Customer cannot identify by name and address
- Services to corporate, governmental, or institutional recipients
- Fraud, harassment, threats, or any activity that endangers staff or third parties
- Any attempt to circumvent the limitations stated in Section 3 (What Bamajan Is and Is Not)
Bamajan reserves the absolute right to refuse, suspend, or terminate any order at its sole discretion, without obligation to disclose the reason.
13Intellectual Property
All content, branding, text, images, and materials on our website are owned by Bamajan or its licensors. You may not copy, reproduce, redistribute, resell, or modify any part of our content without prior written permission.
14Limitation of Liability
To the fullest extent permitted by law:
- Bamajan is not liable for indirect, incidental, or consequential damages
- We are not liable for failures caused by incorrect Customer information
- We are not responsible for delays or force majeure events (weather, government rules, infrastructure outages, etc.)
- Our liability is always limited to the amount paid for the specific service
- We are not liable for any consequences arising from the Customer's misrepresentation in the Customer Declaration
- We are not liable for any consequences arising from the Final Consumer being subject to sanctions or legal restrictions unknown to Bamajan at the time of order
- We are not liable for any consequences arising from actions of the independent Operator that exceed the scope agreed with Bamajan
- We are not liable for any consequences of changes in sanctions regulations or other legal regimes that occur after order acceptance
Nothing in these Terms excludes liability where prohibited by law.
15Indemnification
You agree to indemnify and hold harmless Bamajan against any claims, losses, damages, or expenses arising from:
- Misuse of our Services
- Violations of these Terms
- Providing false or unauthorized data
- Material misrepresentation in the Customer Declaration
- Actions or misconduct of the Final Consumer
16Privacy & Data Protection
Your use of our Services is also governed by our Privacy Policy, which describes what data we collect, how we process it, and how GDPR compliance is ensured. The Privacy Policy forms an integral part of these Terms.
17Service Availability & Changes
We strive to provide uninterrupted, high-quality service but do not guarantee continuous availability, error-free performance, or immediate response times. We may update, improve, or discontinue certain services at any time.
18Records & Regulatory Cooperation
Bamajan retains records of all transactions for a period of seven years in compliance with applicable financial, tax, and anti-money-laundering retention requirements under Dutch law (Wwft) and other applicable laws.
Bamajan will cooperate with lawful inquiries from regulatory authorities and may be required to disclose transaction information to such authorities. By using Bamajan, you consent to such retention and lawful disclosure.
19Updates to These Terms
We may update these Terms at any time. Material amendments will be summarized in a public change log accessible from this page, and the “Last Updated” date will reflect the change. You are responsible for reviewing the current version before each order. Continued use of our Services constitutes acceptance of the updated Terms.
20Governing Law & Jurisdiction
These Terms are governed by the laws of the Netherlands, without regard to conflict-of-law rules. Any disputes must be brought before the competent courts of the Netherlands.
