"Final Consumer" refers to the individual receiving the service if different from the Customer.

We operate as a service platform offering operational, logistical, and concierge-style services delivered either to the Customer or to a Final Consumer designated by the Customer.

3. Eligibility

  • Have the legal capacity to enter into a contract
  • Provide accurate and complete information
  • Purchase Services only for lawful purposes

If you act on behalf of an organization, you represent that you have the authority to bind that organization.

4. Scope of Services

Bamajan provides various remote and physical services, including but not limited to:

  • Full name of the final recipient
  • Delivery address
  • Specific instructions or authorization
  • Concierge services
  • Gift or product delivery
  • Family support services
  • Other customized services within agreed legal boundaries

We reserve the right to refuse services that violate laws, ethical standards, or operational feasibility.

5. Ordering & Contract Formation

A contract is formed when:

  • You submit an order through our website or communication channels, and
  • We accept your order and confirm it via email, invoice, or internal approval.

All purchases are governed by these Terms and the corresponding invoice. We reserve the right to decline or cancel orders at our discretion.

6. Payments & Billing

Failed or Disputed Payments

We may suspend or cancel services if a payment fails, is reversed, or is suspected of fraud.

Taxes

All applicable taxes, VAT, or duties will be added in the invoice where required by law.

  • All payments are processed via Stripe using secure industry standards.
  • We do not store or access credit-card information.
  • Prices are stated in the currency shown at checkout.
  • All payments must be completed before the service is delivered unless otherwise stated.
  • Invoices serve as a legally binding agreement.

7. Customer Responsibilities

The Customer agrees to:

  • Provide accurate and complete information
  • Ensure the legality of the requested service
  • Inform the Final Consumer (if applicable) about relevant privacy obligations
  • Avoid placing orders involving illegal, harmful, or fraudulent activities
  • Cooperate with our team to ensure proper service delivery

If incorrect or incomplete information is provided, Bamajan is not responsible for delays, additional costs, or failed delivery.

8. Delivery to Final Consumers

When a service is ordered for someone else:

  • The Customer guarantees they have the right to share the recipient's personal data
  • Bamajan may contact the recipient directly if required
  • We are not responsible if the recipient refuses the service or is unreachable

We reserve the right to request additional verification for security or compliance reasons.

9. Refunds, Cancellations & Modifications

9.1 Refunds

Refunds may be issued only when:

  • The service has not started
  • The service cannot be delivered due to reasons attributable to Bamajan
  • A legal requirement mandates a refund

When Refunds Are Not Provided

We do not provide refunds when:

  • Incorrect information was provided by the Customer
  • The Final Consumer refused the service
  • Local authorities imposed restrictions outside our control
  • The Customer changes their mind after the service has started

9.2 Cancellations

Cancellation requests must be submitted before the service begins.

Once a service is in progress, cancellation may not be possible.

9.3 Modifications

Modification requests may be accepted if operationally feasible and may incur additional charges.

10. Prohibited Uses

Customers may not use our Services for:

  • Illegal activities
  • Fraud, harassment, or threats
  • Money laundering or sanction-evading transactions
  • Delivery of prohibited or restricted items
  • Activities that endanger staff or third parties

We may refuse or terminate services at any time if misuse is detected.

11. Intellectual Property

All content, branding, text, images, and materials on our website are owned by Bamajan or its licensors.

You may not:

  • Copy
  • Reproduce
  • Redistribute
  • Resell
  • Modify

any part of our content without prior written permission.

12. Limitation of Liability

To the fullest extent permitted by law:

  • Bamajan is not liable for indirect, incidental, or consequential damages
  • We are not liable for failures caused by incorrect customer information
  • We are not responsible for delays or force majeure events (weather, government rules, etc.)
  • Our liability is always limited to the amount paid for the specific service

Nothing in these Terms excludes liability where prohibited by law.

You agree to indemnify and hold harmless Bamajan against any claims, losses, damages, or expenses arising from:

  • Misuse of our Services
  • Violations of these Terms
  • Providing false or unauthorized data
  • Actions or misconduct of the Final Consumer

14. Privacy & Data Protection

Your use of our Services is also governed by our Privacy Policy, which describes:

  • What data we collect
  • How we process it
  • How GDPR compliance is ensured

The Privacy Policy forms an integral part of these Terms.

15. Service Availability & Changes

We strive to provide uninterrupted, high-quality service but do not guarantee:

  • Continuous availability
  • Error-free performance
  • Immediate response times

We may update, improve, or discontinue certain services at any time.

16. Updates to These Terms

We may update these Terms at any time and without prior notice.

The updated version will always be published on our website.

Continued use of our Services constitutes acceptance of the updated Terms.

17. Governing Law & Jurisdiction
